Introduction

This is the Privacy Policy governing your use of the KashADS.com site ("Site") and the transfer, collection, use and processing of your Collected Information by KashADS.com, KashADS (Kashtelyans Ltd) and our affiliates (collectively referred to as "KashADS.com", “ KashADS”, “Kashtelyans Ltd”, "we" or "us"). By using this Site, you consent to our Privacy Policy set out below. All terms not defined in this document have the meanings ascribed to them in the Terms of Use between you and KashADS.com, which by use of this Site you agree to accept. KashADS.com is provided to you by KashADS, which is the registered trading name of Kashtelyans Ltd, Osbourne House, 143-145 Stanwell Road, Ashford, Middlesex, TW15 3QN, United Kingdom, registered in England and Wales under number 07257746. This Privacy Policy is effective as of 18 December 2014.

1. Information We Collect 

1.1.Personal Information

From time to time, our Users/Members may disclose personal data deliberately or inadvertently including without limitation to personal identifiers such as name, email addresses, telephone and mobile numbers, registered address and IP address of individuals in the course of using the Site (“ Personal Information”).

1.2.Marketing Information

From time to time, we gather information about our Users/Members and prospective users during marketing events and other functions for follow-up marketing purposes (“Marketing Information”).

1.3.Registration Information

At the time of registration, when you become a Registered User/Member of the Site, you will be asked to complete a registration form which requires you to provide information such as your name, telephone/mobile number and email address as well information about your business (" Registration Information."). The Site collects only your location from the list selected. KashADS.com will never ask your Date of Birth and full address including your first line of address.

1.3.1. Your Email address is not shown on the Site and if Members provide their email address registered on their account to other Users/Members, they do so at their own risk and responsibility. All Incoming messages received via the web-based message account on KashADS.com will be emailed to the email address registered for that account.

1.3.2. First Name and Surname are displayed to other Users/Members on the Site.

1.3.3. Selecting location is narrowed down by country, county/province/state. Country and location are only displayed to Users/Members, with the exception of Directory Listings, where the first line of address is asked for but not compulsory. The first line of address requested when posting Directory Listings is required for accuracy for other Users/Members to see the location where your services are provided. KashADS will never ask you to provide your full address of Buy or Sell Offers posted.

1.3.4. Telephone/Mobile numbers are for contact by other Users/Members; provided Telephone/Mobile numbers on the website will be disclosed to other Users/members only if you choose to display them on the Site.

1.3.5. Members accept that any sharing or use of their Skype user ID or any communications using Skype are at the Member's own risk.

1.3.6. It is not compulsory to provide member’s direct website, facebook, google plus or twitter page. By providing such information on the Site, each User/Member does so at their own risk and responsibility with regard to managing/adding/sharing their friends or followers on their social pages.

1.3.7. If the type of profile selected is as a Business, the User/Member is required to provide the sole trader or company name or the name under which they are trading.

1.4.Statistical Information

In addition, we gather statistical information about our Site and Users/Members, such as operating system, browser software, IP addresses, software and hardware attributes, pages viewed, number of sessions, unique visitors and so forth ("Statistical Information")

1.5.Account Activities Information

We record and retain the records of your Account activities when you use KashADS.com services (“Account Activities Information”)

1.6.Member Information

We record and retain records of Buying Offers, Selling Offers, Directory Listings and browsing activities on our platform, including but not limited to browsing patterns, IP addresses, User/Member behavioural patterns, User/Member contact details, User/Member profiles and so forth (“ Member Information”).

1.7.Publishing Information

If you submit any information to KashADS.com to be published on the Site through the publishing tools, including but not limited to Private or Business Profile, then you are deemed to have given consent to the publication of such information so long as they do not pertain to personal information (" Publishing Information")

1.8.Payment Information

If you selected and established one of the Premium Levels of Membership (Silver, Gold or Platinum Membership) using a credit/debit card or PayPal account, that information is obtained and stored with PayPal only. KashADS does not hold or keep any payment information you provided to PayPal when acquiring Premium Membership. We may collect additional information from PayPal such as billing information where we might send invoice(s) if requested by the User/Member for the services provided by KashADS.com ("Payment Information").

1.9.Collected Information

Registration Information, Publishing Information, Member Information, Payment Information, Account Activities Information, Statistical Information, Marketing Information, Personal Information and any information we may collect from you through the use of cookies highlighted in our Cookies Policy or from our affiliates or from other parties or through any other means, shall collectively be referred to as ("Collected Information").

1.10. Stored Information

Information posted on KashADS.com is obviously available publicly to other Users/Members. Our servers are located in the United Kingdom, United States and Germany. The laws on holding personal data in the United States may be less stringent than the laws applicable to the UK and Ireland, but KashADS.com will hold and transmit your information in a safe, confidential and secure environment. If you choose to provide us with personal information, you are consenting to the transfer and storage of that information on our servers located in the United Kingdom, United States and Germany.

1.11. Downloading and use of Mobile application(s)

When you download or use our Mobile Application(s), or access our mobile optimised site, we may receive information about your location and your mobile device, including a unique identifier for your device. We may use this information to provide you with location-based services, such as advertising, search results and other personalised content. Most mobile devices allow you to control or disable location services in the device's setting's menu. If you have questions about how to disable your device's location services, we recommend you contact your mobile service carrier or the manufacture of your particular device.

1.12. Performing Advanced Search on the Site

In order to conduct an Advanced Search on KashADS.com, for optimised results we will request you to supply (although it is not compulsory) a location and a selection of identifying criteria matching your chosen Buy Offer, Sell Offer, Directory Listing and Profile, e.g. category and price. 

2. Disclosure of Information

2.1.We do not sell or rent your Personal, Registration and Member Information to third parties for their marketing purposes without your explicit consent. We may disclose Personal Information to respond to legal requirements, enforce our policies, respond to claims that a posting or other content violates others' rights, or protect anyone's rights, property, or safety (for example, if you submit false contact details or impersonate another person, we may pass your Personal, Registration and Member Information to any aggrieved third party, their agent or to any law enforcement agency).

2.2.We may publish records of complaints and any penalties, actions or proceedings against Members. We further reserve the right to disclose your Collected Information to relevant authorities where we have reason to believe that such disclosure is necessary to contact, identify or bring legal action against someone who may be infringing or threatening to infringe, or who may otherwise be causing injury to or interference with, the title, rights, interests or property of KashADS.com, our Users and Members, customers, partners, other web site users or anyone else who could be harmed by such activities.

2.3.We also reserve the right to disclose Collected Information in response to a subpoena or other judicial order, or when we reasonably believe that such disclosure is required by law, regulation or administrative order of any court, governmental or regulatory authority.

2.4.If we have reason to believe that a User/Member is in breach of the Terms of Use, Privacy Policy or any other agreement with us, then we reserve the right to make public or otherwise disclose such User's Collected Information in order to pursue our claim or prevent further injury to KashADS.com or others.

3. How We May Use the Information

3.1.General

3.1.1. We may use your Collected Information to execute marketing campaigns, promotions or advertising messages on behalf of third parties; however, in these circumstances, your Collected Information will not be disclosed to such third parties unless you respond to the marketing, promotion or advertising message. Your Collected Information may be transferred, stored, used and processed outside your home jurisdiction. In case of a merger with or transfer of business to another business entity, we will transfer your Collected Information to the entity that acquires the business (should such a combination occur, we will require that the new combined entity follow our Privacy Policy with respect to your Collected Information).

We do not otherwise sell, rent, trade or exchange any personally-identifying information of our Users.

3.2.Personal Information

3.2.1. Each of our members is expressly prohibited from using any Personal Information for illegal activities including without limitation to spamming.

3.2.2. The use of any Personal Information by any of our members is subject to privacy laws in the respective jurisdictions of our members.

3.2.3. Each of our members is solely responsible for observing applicable laws and regulations in their respective jurisdictions to ensure that all use of the Site and Services is in compliance with the same.

3.3.Registration Information

We may use your Registration Information to provide services that you request or to contact you regarding additional services about which KashADS.com determines that you might be interested. Specifically, we may use your email address, telephone number or mobile number to contact you regarding surveys, notices, new services, product alerts or product offerings and communications relevant to your use of the Site. We may generate reports and analysis based on your Registration Information for internal monitoring, analysis and marketing decisions.

3.4.Statistical Information

We use Statistical Information to help diagnose problems with and maintain our computer servers, to manage our Site and to enhance our Site and services based on the usage pattern data we receive. We may generate reports and analysis based on the Statistical Information for internal monitoring, analysis and marketing decisions. We use Member Information to provide value-added services to our members, including without limitation to providing Users/Members patterns and Users/Members behavioural data to our members to facilitate marketing initiatives and decision making.

3.7.Publishing Information

All of your Publishing Information will be publicly available on the Site and therefore accessible by any internet user. Any Publishing Information that you disclose to KashADS.com becomes public information and you relinquish any proprietary rights (including but not limited to the rights of confidentiality and copyrights) in such information. You should exercise caution when deciding to include personal or proprietary information in the Publishing Information that you submit to us.

3.8.Payment Information

KashADS.com will not share your Payment Information with banks or vendors. Payment Information provided is stored and saved by PayPal and PayPal is responsible for your current and future payments made to KashADS (Kashtelyans Ltd). While PayPal has in place up-to-date technology and internal procedures to guard your Payment Information against intruders, there is no guarantee that such technology or procedure can eliminate all risks of theft, loss or misuse. KashADS.com shall not be liable to you or any other person for any damages that might result from unauthorized use, publication, disclosure or any other misuse of Payment Information, including credit/debit card information or Bank Account Details. 

4. Accessing and Correcting Your Information

4.1. You can access, view and edit your Registration Information and Publishing Information (if any) through your account with KashADS.com.

4.2. You can access, view and edit your Payment Information (if any) through your PayPal account.

5. Security Measures

5.1.No data transmission over the Internet or any wireless network can be guaranteed to be perfectly secure. As a result, while we try to protect your information, no web site or company, including ourselves, can absolutely ensure or guarantee the security of any information you transmit to us and you do so at your own risk.

5.2.As a Registered User/Member, your Registration Information and Publishing Information (if any) can be viewed and edited through your account which is protected by Password. We recommend that you do not divulge your Password to anyone. Our personnel will never ask you for your Password in an unsolicited phone call or in an unsolicited email. If you share a computer with others, you should not choose to save your login information (e.g., User ID and Password) on that computer. Remember to sign out of your Account and close your browser window when you have finished your session.

5.3.We employ commercially reasonable security methods to prevent unauthorized access, maintain data accuracy and ensure correct use of information.

6. Changes to Privacy Policy 

6.1.Any changes to this Privacy Policy will be communicated by us via the posting of an amended and restated Privacy Policy on the Site. Our posting of the amended and restated Privacy Policy will make such new Privacy Policy immediately effective. You agree that all Collected Information (whether collected prior to or after the new policy becomes effective) will be governed by the newest Privacy Policy in effect at that time. 8. Minors

8.1.The Site and its contents are not intended to target minors under applicable law and we do not intend to sell any of our products or services to minors. However, we have no way of distinguishing the age of individuals who access the Site and therefore we carry out the same Privacy Policy for individuals of all ages. If a minor has provided us with personal information without parental or guardian consent, the parent or guardian should contact us to remove the information.
